Privacy Policy

This Privacy Policy (“Policy”) sets out how Ev Chapman, a sole trader of Sydney, New South Wales, Australia (“we”, “us”, “our”), collects, holds, uses, discloses and protects personal information obtained through the website at evchapman.com (the “Website”) and through the products, memberships and services offered on it.

This Policy is issued in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Where the General Data Protection Regulation (EU) 2016/679 (“GDPR”) or the UK General Data Protection Regulation applies to you, clause 11 also applies.

By using the Website, subscribing to a mailing list or placing an order, you consent to the collection, use and disclosure of your personal information in accordance with this Policy.

1. The information we collect

1.1 Contact information. Your first name and email address, where you subscribe to a mailing list, request a free resource or contact us directly.

1.2 Transaction information. Your name, email address, billing address, country of residence and the particulars of your order, where you purchase a product, membership or service. Payment card details are collected and processed by our payment providers and are not received, processed or stored by us.

1.3 Membership information. The information you elect to publish in your community profile, together with the posts, comments and messages you contribute within the community platform.

1.4 Comment information. The name you elect to supply, which is optional, and the text of any comment submitted on an article. No account, registration or email address is required in order to comment, and none is collected.

1.5 Correspondence. The content of any communication sent to us and the address from which it is sent.

1.6 Technical and usage information. Pages viewed, the date and duration of a visit, the referring website or link, approximate location derived from IP address at country or city level, and browser and device characteristics. This information is collected in aggregate and is not used by us to identify an individual.

1.7 Engagement information. Whether an email sent by us has been opened and which links within it have been selected.

1.8 We do not collect sensitive information as that term is defined in the Privacy Act 1988 (Cth).

2. How we collect it

2.1 Personal information is collected directly from you when you submit it through a form, place an order, join the community, submit a comment or correspond with us.

2.2 Technical and usage information is collected automatically through cookies and analytics services when you access the Website, as described in clause 4.

2.3 Where personal information is collected from a third party, such as a checkout provider processing your order, it is collected for the purposes set out in clause 3.

2.4 You are not obliged to provide your personal information. Where it is not provided, we may be unable to supply a product, fulfil an order or respond to an enquiry.

3. Why we collect, hold, use and disclose it

3.1 To supply the products, memberships and services you have ordered and to provide associated support.

3.2 To send newsletters, resources and other communications you have requested, and to send marketing communications in accordance with clause 8.

3.3 To operate and administer the community platform.

3.4 To analyse the use of the Website and of our communications in order to improve their content and performance.

3.5 To plan, deliver and measure the effectiveness of advertising, as described in clause 4.

3.6 To verify identity, prevent fraud and enforce our Terms and Conditions.

3.7 To comply with obligations imposed by law, including taxation and record-keeping obligations.

4. Cookies, analytics and advertising

4.1 A cookie is a small data file stored by your browser. The Website uses cookies that are necessary for its operation, cookies that support analytics, and, where advertising is being conducted, cookies and tracking pixels placed by advertising platforms.

4.2 Analytics services provide aggregated statistics concerning the use of the Website. They are used to measure traffic and content performance and not to identify individual visitors.

4.3 Where we conduct paid advertising on platforms including Meta Platforms (Facebook and Instagram), Google and YouTube, and LinkedIn, those platforms may place a cookie or tracking pixel on the Website. Its function is to record that a person who was shown an advertisement subsequently visited a page or completed a purchase, and to enable advertisements to be shown to previous visitors. Results are reported to us in aggregate. We do not receive from those platforms a list identifying the individuals concerned.

4.4 You may refuse, disable or delete cookies through your browser settings, and you may restrict advertisement personalisation through the settings made available by each advertising platform. Refusing analytics and advertising cookies does not impair the operation of the Website.

5. Disclosure to service providers

5.1 We disclose personal information to the service providers engaged to operate this business, in each case limited to the information required for the relevant function and subject to the provider's obligation not to use it for its own purposes.

5.3 We may also disclose personal information where disclosure is required or authorised by law, is necessary to establish, exercise or defend a legal claim, or is necessary to prevent a serious threat to the life, health or safety of any person.

5.4 We do not sell personal information, and we do not disclose your contact details to any third party for that party's own marketing purposes.

6. Disclosure outside Australia

6.1 The majority of the service providers identified in clause 5.2 are located in the United States. Personal information disclosed to them is stored and processed outside Australia.

6.2 We take reasonable steps to engage providers that maintain appropriate safeguards in respect of the information disclosed to them. You consent to that disclosure by using the Website and, in doing so, acknowledge that Australian Privacy Principle 8.1 will not apply to the overseas recipient.

7. Storage, security and retention

7.1 Personal information is held on systems operated by the providers identified in clause 5.2 and is protected by access controls and other reasonable technical and organisational measures.

7.2 No method of transmission or storage is entirely secure. While we take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, we do not warrant absolute security.

7.3 Where an eligible data breach occurs, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with Part IIIC of the Privacy Act 1988 (Cth).

7.4 Contact information is retained until you unsubscribe. Following unsubscription, a record is retained by our email provider for the purpose of ensuring you are not re-subscribed in error.

7.5 Records of transactions are retained for not less than five years, as required by Australian taxation law, notwithstanding any request for erasure made under clause 10.

7.6 Membership information is retained for the duration of the membership and for a reasonable period thereafter. Comments are retained until removal is requested. Technical and usage information is retained in aggregated form.

7.7 Personal information no longer required for a purpose set out in clause 3, and not required to be retained by law, is destroyed or de-identified.

8. Direct marketing

8.1 Marketing communications are sent only where you have subscribed or have otherwise consented to receive them.

8.2 Every marketing communication contains a functional unsubscribe facility. You may also withdraw consent at any time by written notice to ev@evchapman.com.

8.3 Withdrawal of consent to marketing does not affect communications necessary to supply a product you have purchased or to administer a membership.

9. Comments and community content

9.1 Comments submitted on articles are published publicly, together with any name supplied. You should not include personal information in a comment that you do not wish to be published.

9.2 Content contributed within the community platform is visible to other members of that platform. We are not responsible for the use another member makes of information you elect to publish there.

10. Access, correction and erasure

10.1 You may request access to the personal information we hold about you, request its correction, request its erasure, or request that we cease using it for marketing purposes.

10.2 Requests must be made in writing to ev@evchapman.com. We will respond within 30 days.

10.3 We may decline a request for access or erasure where we are required or permitted by law to refuse it, including in respect of records retained under clause 7.5. Where a request is declined, we will provide written reasons.

10.4 We may require verification of identity before acting on a request.

11. Rights under the GDPR and UK GDPR

11.1 Where the GDPR or the UK GDPR applies to you, the lawful bases on which we process personal information are consent in respect of marketing, performance of a contract in respect of orders and memberships, compliance with a legal obligation in respect of records retained under clause 7.5, and our legitimate interests in operating, securing and improving the Website and this business.

11.2 You have the right to access your personal information, to have it rectified or erased, to restrict or object to its processing, to withdraw consent at any time, and to receive your personal information in a portable form.

11.3 Rights under this clause are exercised in the manner set out in clause 10.2.

11.4 You have the right to lodge a complaint with the supervisory authority in your jurisdiction.

12. Complaints

12.1 A complaint concerning the handling of your personal information should be sent to ev@evchapman.com. We will acknowledge it promptly and respond within 30 days.

12.2 If you are not satisfied with our response, you may refer the complaint to the Office of the Australian Information Commissioner, GPO Box 5218, Sydney NSW 2001, or at oaic.gov.au.

13. Children

13.1 The Website and the products offered on it are directed to adults. They are not directed to persons under 16 years of age, and we do not knowingly collect personal information from a person under that age. Where we become aware that such information has been collected, it will be deleted.

14. Third-party websites

14.1 The Website contains links to websites operated by third parties. Those websites are not governed by this Policy, and we are not responsible for their privacy practices. You should review the privacy policy of any such website before providing personal information to it.

15. Changes to this Policy

15.1 This Policy may be amended from time to time. The current version is the version published on this page, and the date of the most recent amendment appears at the top of it.

15.2 Where an amendment materially affects the handling of personal information already collected, notice will be given by email or by a notice published on the Website.
